1. Introduction

Welcome to the "Towasl" platform. These Terms and Conditions ("Terms") govern your use of the Towasl platform ("Platform") provided by Ashkal Information Technology Company. By using the Platform, you agree to be bound by these Terms and Conditions.

2. Definitions

• Company: Ashkal Information Technology Company, the owner and operator of the Towasl platform
• Platform: The Towasl electronic platform with all its services and applications
• User: Any person who uses or registers on the Platform
• Activity: Any event or occasion created or joined by Users through the Platform
• Content: Any text, image, or information published by the User on the Platform
• Account: The User's personal profile on the Platform
• Chat: The text and visual messaging service available between Users on the Platform
• Message: Any text or visual content sent through the chat service
• Group: A collective communication space created by Users for interaction and creating shared activities
• Group Owner: The User responsible for managing the Group, not an actual owner of it in the application in any form
• Group Admin: A member appointed by the Group Owner to help manage the Group
• Stickers: Images or expressive graphics provided by the Platform for use in chats

3. Service and Company Definition

Towasl is a social platform that connects people through diverse activities. The Company operates as an intermediary platform to facilitate communication and interaction between Users.

4. Eligibility for Use

• Users must be 18 years of age or older
• Users must be residents of the Kingdom of Saudi Arabia
• Users must provide accurate and correct information when registering
• The Company reserves the right to refuse service to anyone for any reason

5. Registration and Account

5.1 Account Creation

• Registration requires a valid mobile phone number
• Phone number must be verified via verification code (OTP)
• Personal profile must be completed with required information

5.2 Account Security

• Users are responsible for maintaining the confidentiality of their account information
• Users must immediately notify the Company of any unauthorized use of their account
• The Company is not responsible for any losses resulting from failure to protect account information

6. Platform Use

6.1 Permitted Use

• Creating and joining appropriate social activities
• Interacting with other Users in a respectful manner
• Sharing appropriate and legal content
• Using the chat service for activity-related communication and adding people
• Sending appropriate text messages, images, and stickers through chats
• Creating, managing, and joining Groups
• Using stickers available on the Platform in chats

6.2 Prohibited Use

• Publishing offensive, inappropriate, or content contrary to public morals
• Harassment, bullying, or threatening other Users
• Impersonating others or providing false information
• Using the Platform for unauthorized commercial purposes
• Publishing content that violates Saudi laws or Islamic Sharia
• Attempting to hack or damage the Platform or its servers
• Sending offensive, harassing, or inappropriate content messages
• Sending spam or unwanted commercial messages
• Sharing inappropriate or immoral images or visual content
• Using chats for illegal or unlawful purposes
• Misusing Groups or using them for prohibited purposes
• Using stickers in an offensive or immoral manner
• Copying or distributing stickers outside the Platform

7. Chat and Messaging Service

7.1 Service Nature

• The Platform provides text and visual chat service between Users
• Chats include: activity chats, personal chats, and group chats
• Text messages, images, and stickers can be sent through chats
• Instant notifications are available for new messages
• Group chats are available for communication between Group members

7.2 Chat Usage Rules

• Chats must be used in a respectful and polite manner
• Sending offensive, inappropriate, or immoral content is prohibited
• Harassment or annoyance through messages is prohibited
• Sending spam or unwanted commercial messages is prohibited
• Chat privacy must be respected and content should not be shared outside the Platform

7.3 Content Monitoring

• The Company reserves the right to monitor chat content to ensure compliance with Terms
• Action may be taken against Users who violate chat rules
• Users can report offensive or violating content

7.4 Message Storage and Deletion

• Messages are stored on Platform servers to ensure service continuity
• Users can delete their own messages
• Chats may be automatically deleted after related activities end
• The Company reserves the right to delete violating content

7.5 Chat Privacy

• Chats are private to participants only
• Chat content is not shared with third parties except in legal cases
• Users can block or mute other Users
• Privacy settings apply to all types of chats

7.6 Disclaimer for Shared Content

• We are not responsible for any content posted by Users
• We are not responsible for any unauthorized sharing of your content
• Use at your own risk: Use the chat service with understanding of these risks

7.7 Groups

7.7.1 Group Ownership

• "Group Owner" term: Refers only to administrative responsibility, not actual ownership of the Group in the application in any form
• Company Authority: The Company has the right to delete, modify, or transfer management responsibility of any Group without prior notice

7.7.2 Group Owner Responsibilities

• Group Owner is responsible for managing the Group and overseeing its content
• Group Owner is responsible for ensuring members comply with Platform rules
• Group Owner is responsible for taking appropriate action against violators
• Group Owner bears responsibility for any violations occurring in the Group
• Group Owner must transfer responsibility to another member before leaving the Group

7.7.3 Group Admin Responsibilities

• Group Admin is responsible for assisting the Owner in managing the Group
• Admin can invite and remove members (except Owner and other Admins)
• Admin can create activities for the Group and delete violating messages
• Admin shares part of the responsibility for Group management

7.7.4 Group Disclaimer

• The Company is not responsible for content posted in Groups
• The Company is not responsible for any disputes between Group members
• The Company is not responsible for any damages resulting from Group participation
• Users are responsible for choosing which Groups to join

7.8 Stickers

• Sticker Ownership: All stickers available on the Platform are owned by the Company
• Limited License: Users are granted a limited, non-exclusive license to use stickers within the Platform only
• Copying Prohibited: Copying, distributing, or using stickers outside the Platform is prohibited
• Right to Remove: The Company has the right to remove or modify any stickers at any time
• Appropriate Use: Stickers must be used appropriately and not contrary to public morals

8. Privacy and Data Protection

9. Intellectual Property and Data Rights

9.1 Platform Intellectual Property

• All intellectual property rights of the Platform are reserved to the Company
• By publishing content, Users grant the Company a license to use it within the service framework
• Content sent through chats remains owned by the User with a license granted to the Company for storage and display
• All Groups created on the Platform are fully owned by the Company
• All stickers available on the Platform are owned by the Company

9.2 Company Rights in Data and Content

The Company retains full and unlimited rights to all data and information available on the Platform, including but not limited to:

9.2.1 Types of Data Covered

• User Identifiers: User ID (DUID), Firebase ID, Device ID, and OneSignal ID
• Personal Data: Name, birth year, gender, phone number, and profile picture
• Location Data: Geographic coordinates, city, region, and neighborhood
• Activity Data: Created and participated activities, attendance times, and interaction history
• Chat Data: Text messages, images, stickers, send times, and read status
• Group Data: Created and joined Groups, roles, management history, and interactions
• Behavioral Data: Usage patterns, preferences, and Platform interaction history
• Technical Data: Error logs, performance data, and device information
• Any Other Data: Collected, created, or stored on the Platform

9.2.2 Permitted Purposes for Use

• Any Commercial Purpose: Including sale, licensing, or financial benefit from data
• Analysis and Research: Behavioral analysis, academic research, and market studies
• Product Development: Developing new platforms, improving current services, and creating innovative solutions
• Artificial Intelligence: Training models, developing algorithms, and improving smart systems
• Marketing and Advertising: Targeted advertising, marketing campaigns, and audience analysis
• Sharing with Others: Sharing data with partners, investors, or third parties
• Any Other Purpose: The Company deems appropriate for its commercial or operational interests

9.2.3 Scope of Rights

• These rights are permanent and irrevocable even after account deletion
• Rights include all derived and analyzed data from original data
• These rights do not require additional consent from the User
• These rights apply to all data regardless of collection method or source

10. Service Termination

10.1 Termination by User

Users can terminate their account at any time through Platform settings. Upon account deletion, all chats and messages associated with the account will be deleted.

10.2 Termination by Company

The Company has the right to suspend or terminate and delete a User's account in case of violation of these Terms or for any other reason it deems appropriate. This includes violations of chat and messaging rules.

11. Disclaimer

• The Platform is provided "as is" without any warranties
• The Company is not responsible for any direct or indirect damages
• Users are responsible for their personal safety during activities
• The Company is not responsible for content published by Users
• The Company is not responsible for message content exchanged between Users
• Users are responsible for using the chat service appropriately
• The Company is not responsible for any screenshots or sharing of chat content outside the Platform
• The Company does not guarantee privacy of content sent in chats from being shared by recipients
• Users use the chat service at their own full responsibility with knowledge of the possibility of content sharing
• All claims related to privacy violations through content sharing are outside the Company's responsibility
• The Company is not responsible for any content or activities occurring within Groups
• Group Owner and Admins bear full responsibility for Group management and content

12. Applicable Law

These Terms and Conditions are governed by the laws of the Kingdom of Saudi Arabia and Islamic Sharia provisions. Any dispute arising from Platform use is subject to the jurisdiction of Saudi courts.

13. Account Management and Restrictions

• The Company reserves the right to suspend, freeze, or delete any User's account with or without reason
• Action may be taken against Users for non-compliance with activities or Terms violations
• The Company has the right to implement a User behavior evaluation system and impose restrictions accordingly to contribute to improving Platform use for everyone
• All decisions related to account management are final and non-appealable
• Chat usage restrictions may be applied in case of messaging rule violations
• Restrictions on creating or managing Groups may be applied to any User as the Company sees fit
• The Company has the right to transfer Group management responsibility to another member or delete the Group

14. Activity Commitment

14.1 General Commitments

• Users are obligated to commit to activities they create or join
• Users are required to confirm attendance and adhere to activity schedules they create or join
• Non-compliance may result in account restrictions

14.2 Activity Creator/Participant Responsibilities

• Activity creator/participant is responsible for managing and organizing the activity they create
• Activity creator/participant must arrive early to the activity location to receive participants
• Activity creator/participant is responsible for welcoming and guiding participants
• Activity creator/participant must execute the activity according to the published description
• Activity creator/participant is responsible for informing participants of any changes or additional instructions
• Activity creator/participant bears responsibility as the activity host

14.3 Commitment Enforcement

• The Company reserves the right to apply any measures it deems appropriate to ensure compliance

15. Company Protection

• The Company owning the Platform is an intermediary and bears no responsibility for misuse
• The Company is not responsible for any damages, losses, or accidents resulting from Platform use
• Users are fully responsible for their personal safety and property
• Users undertake to compensate the Company for any claims or damages
• The Company reserves its right to take any legal action

16. Terms Modification

The Company reserves the right to modify these Terms and Conditions at any time and Terms should be reviewed periodically.
